1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and AIRPLAY ONE SRL ("Company," "we," "us," or "our") concerning your access to and use of our website and services, including the Blade XR platform.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

2. Services Description

AIRPLAY ONE SRL provides enterprise software solutions, including but not limited to:

  • Blade XR Platform (CRM, PIM, ERP, Service Management)
  • Custom software development
  • Mobile and web application development
  • System integration services
  • Technical consulting and support

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms.

You are responsible for:

  • Safeguarding your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is up to date

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of AIRPLAY ONE SRL. The Service is protected by copyright, trademark, and other laws of Romania and the European Union.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Acceptable Use

You agree not to use our services:

  • In any way that violates any applicable law or regulation
  • To transmit any unauthorized advertising or promotional material
  • To impersonate any person or entity
  • To interfere with or disrupt the service or servers
  • To attempt to gain unauthorized access to any portion of the service
  • To collect or harvest any personal information from other users
  • For any purpose that is harmful or fraudulent

6. Payment Terms

For paid services, the following terms apply:

  • All fees are quoted in EUR unless otherwise specified
  • Payment terms are as specified in individual contracts or invoices
  • Late payments may incur interest at the legal rate
  • We reserve the right to suspend services for non-payment
  • Refunds are handled according to specific service agreements

7. Service Level & Support

We strive to maintain high availability of our services. Specific service level agreements (SLAs) may be established in individual contracts. Standard support includes:

  • Email support during business hours (Monday-Friday, 9:00-18:00 EET)
  • Response within 24-48 hours for general inquiries
  • Priority support available under premium agreements
  • Scheduled maintenance with advance notice

8. Limitation of Liability

To the maximum extent permitted by law, AIRPLAY ONE SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, revenue, or data
  • Business interruption
  • Loss of goodwill or reputation
  • Cost of substitute services

Our total liability shall not exceed the amount paid by you for the services in the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless AIRPLAY ONE SRL from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our services or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Non-payment of fees
  • Fraudulent or illegal activity
  • At your request

Upon termination, your right to use the services will immediately cease. Provisions of these Terms that should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after revisions become effective, you agree to be bound by the revised terms.
